WHAI 2010 “BACKYARD BBQ” OFFICIAL CONTEST RULES

These are the rules governing the “Backyard BBQ” giveaway on WHAI. The grand prize consists of a brand new gas grill from Greenfield Farmers Cooperative Exchange in Greenfield, and a catered BBQ for 25 people at the winner’s home. This contest runs from July 24^th, 2010 through August 16^th, 2010.

1. No purchase necessary.

2. To be eligible to win the prize, you must first become one of 98 “qualifiers” who will be entered into a grand prize drawing on August 16^th , 2010.

3. Between July 25^th, 2010 and August 13^th, 2010, WHAI will make appearances at participating sponsors. During those appearances, which will be promoted ahead of time on the air, listeners can enter their name in a registration box. A minimum of five names will be drawn from each registration box, and those names will become qualifiers. Listeners may only qualify once during the duration of the contest. Only one entry per person is allowed at each sign-up location. Listeners must be present to enter a registration slip.

4. Grand prize winner will be determined by a random drawing of all those qualified on August 16^th , 2010. The qualifier need not be listening to win. Winner will be notified by phone.

5. Winner must pick a weeknight between August 17^th 2010 and August 27^th 2010 to hold the BBQ. All food will be provided by WHAI. WHAI will also provide a new gas grill, which will stay with the winner after the BBQ. WHAI will NOT provide any alcoholic beverages, and will not be held responsible for the actions of any guest found to be under the influence of alcohol. WHAI reserves the right to end the BBQ and leave the premises if persons under the influence of alcohol cause an unsafe environment in the opinion of the WHAI staff members at the BBQ, or if underage guests are witnessed consuming alcohol.

6. WHAI will make every attempt to have WHAI personalities Jay Fidanza, Bobby C. and Nick Danjer present at the BBQ. But it will depend on the date chosen by the winner and the availability of those personalities on the date in question.

7. In the event the winner is subject to or the subject of any order or legal process issued by any government agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgement, lien, and the like), WHAI’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be deemed to be awarded to the winner. WHAI shall be entitled to rely, in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. WHAI shall not be liable for any claim by winner for damages incidental thereto.

8. This contest is open to all eligible U.S. residents 18 and over. Contestants must posses a valid I.D. or other means of I.D. acceptable to WHAI. WHAI, their advertising agencies, affiliates, sponsors, employees, and families are not eligible to win and no substitute for prizes will be awarded. All federal, state, and local laws and regulations apply. WHAI reserves the right to disqualify any winner if the contest rules have been violated in any way. Contest void where prohibited. WHAI reserves the right to substitute a prize of similar value.

9. WHAI, Saga Communications of New England, Inc., it’s parent corporation, Saga Communications, Inc., their agencies, employees, and representatives absolve themselves and shall be held harmless from any action or liability arising from the “Backyard BBQ” contest or the prizes awarded in said contest.

10. WHAI reserves the right to interrupt and/or discontinue this promotion, at the discretion of WHAI management, if world events, the national mood, or public safety so warrant. WHAI reserves the right to amend these rules at any time. The judges’ decision is final.

11. WHAI shall have no responsibility for failure to win or claim any prize based on difficulties with external circumstances.

12. No cash equivalent will be awarded.

13. Winner is responsible for all taxes on prizes awarded, and will be required to fill out the appropriate tax paperwork at the WHAI studios prior to taking possession of the prizes. Winner will be sent an IRS 1099 MISC federal tax form for the value of the prizes.

14. WHAI reserves the right to use the voice and/or picture of any and all winners for promotional and broadcast purposes.

15. Copies of these rules are available at the WHAI studios, 81 Woodard Rd., Greenfield, Massachusetts, weekdays between 8am and 5pm.

These are the rules governing all contests aired on radio stations WHAI and WPVQ, owned by Saga Communications of New England.

There is never any purchase necessary to enter any contest.
To be eligible to win any prize on the station, you must not have won anything from us during the previous 30 days, or any prize valued at $600 or more during the previous year. Some station contests will have specific rules that may amend these eligibility values, and these rules will be aired on the station during said contest. Any prize awarded to an ineligible listener will be deemed null and void and an alternate eligible winner may be named.
Anytime you call the station’s studios, you assume that your call will be broadcast or recorded, and you grant us permission to broadcast the call or record it for later broadcast.
As a winner of a station contest, your voice, name or picture may be used for promotional, broadcast or internet purposes.
Prizes awarded are not redeemable for cash. Prizes are not transferable. No substitution for a prize will be made at the request of the winner. The station reserves the right to substitute a prize of similar value.
Winners of contests are responsible for all taxes on prize awarded. Winners of a prize valued at $600 or more will be required to fill out the appropriate tax forms at the station prior to claiming prize.

Saga Communications shall be entitled to rely, in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. The radio stations shall not be liable for any claim by any winner for damages incidental thereto.
Contests are open to all eligible U.S. residents. Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to the station.
In most cases, winners will be required to claim prizes at the station’s studios, 81 Woodard Rd., Greenfield, MA, between 8am and 5pm any Monday through Friday, excluding holidays. Prizes must be claimed within 30 days of winning. Prizes not claimed within 30 days will be forfeited, and may be returned to the station prize pool.
WHAI, WPVQ, Saga Communications of New England, Inc., it’s parent corporation, Saga Communications, Inc., their advertising agencies, affiliates, contest sponsors, employees, representatives, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any station contest or the prize awarded in any contest.
Employees of Saga Communications, their advertising agencies, affiliates, contest sponsors, and immediate families of each are not eligible to win prizes.
As a public licensee and a trustee of the public airwaves, WHAI and WPVQ reserve the right to interrupt and/or discontinue any promotion or contest at the discretion of station management if world events, the national mood, or public safety so warrant. We reserve the right to amend the rules of any contest at any time. The judges decision is always final.
All federal, state and local laws and regulations apply. Contest is void where prohibited.
The station reserves the right to disqualify any winner if contest rules have been violated in any way.
For any contest requiring phone entry, you must only the (413) 774-6565 studio number for WHAI; (413) 773-9530 for WPVQ, unless otherwise specified. The person operating the phone at the studio has the final decision as to who is the winning caller.
WHAI shall have no responsibility for failure to win or claim any prize based on difficulties with telephone, facsimile machine, internet, or any other circumstances in any station contest.
